This Privacy Policy applies to all Personal Information collected by Sarah L Barnett (“We”, “Us” or “Our”) via the website located at www.sarahlbarnett.com (Website).

Sarah Barnett provides quality services to you and this Privacy Policy explains Our obligations to you in the way We manage your Personal Information in relation to the Australian Privacy Principles (“APPs”) contained in The Privacy Act 1998 (Cth) (“Privacy Act”). The APPs govern the way in which We collect, store, secure, use and dispose of your Personal Information.

Children may subscribe to Our mailing list with the consent of their parent or adult carer.

1. What information do We collect?

The kind of Personal Information that We collect from you will depend on how you use the Website. The Personal Information which We collect and hold about you may include:

(a)        Name (if provided);

(b)        Email address;

The Privacy Act defines types of information, including Personal Information and Sensitive Information.

(a)        Personal Information

Personal Information means information or an opinion about an identified individual or an individual who is reasonably identifiable:

(i)          whether the information or opinion is true or not; and

(ii)         whether the information or opinion is recorded in a material form or not.

If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as “Personal Information” and will not be subject to this privacy policy.

Sensitive Information is defined in the Privacy Act as including information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive Information will be used by Us only:

(i)          for the primary purpose for which it was obtained;

(ii)         for a secondary purpose that is directly related to the primary purpose; and

(iii)        with your consent or where required or authorised by law.

3. How We collect your Personal Information

(a)        We may collect Personal Information from you whenever you input such information into the Website or provide it to Us in any other way. Personal Information may be obtained through subscribing to our mailing list, by email, by correspondence, by providing feedback or via our Website www.sarahlbarnett.com, from content we receive that you post on social media pages, from your website, from media and publications. 

(b)        We may also collect cookies from your computer which enable Us to tell when you use the Website and also to help customise your Website experience. As a general rule, however, it is not possible to identify you personally from Our use of cookies.

(c)         We generally do not collect Sensitive Information, but when We do, We will comply with the preceding paragraph.

(d)        Where reasonable and practicable We collect your Personal Information from you only. However, sometimes We may be given information from a third-party, in cases like this We will take steps to make you aware of the information that was provided by a third-party.  We do not guarantee the website links or policies of authorised third-parties.  If you access a linked website to make a product purchase, such as Amazon or Audible, any information that you provide to such third-party will be subject to that third-party’s privacy policy and terms and conditions. We may receive personal information about you from companies that make user-generated content from their service which is available to others, such as public social media posts.

(e)        We or our third-party service providers may collect information from email providers, communication providers and social networks, such as your email interactions with Us and whether you open and/or forward emails.  Via our Website you can follow Us on Facebook and Instagram, and any information you choose to share on social media may potentially be visible to a global audience and will be subject to the social media provider’s privacy policies (not Our Privacy Policy).

(f)          We may provide opportunities for you to publicly post reviews, comments, suggestions or questions which may include Personal Information such as your name.

(g)        We may automatically collect Personal Information about your use and interactions with Our Website, newsletters, email updates and marketing campaigns that we issue, including your page view information and whether a marketing campaign that has been sent to you has been viewed, delivered, opened, clicked on, whether it has bounced or treated as spam.

4.          Purpose of collection and Disclosure of Personal Information

(a)        We collect Personal Information to provide you with the best service experience possible on the Website to provide services to you, provide newsletters and updates and to keep in touch with you about developments in Our business (“primary purpose”). 

(b)        We and our services providers may collect and use your Personal Information for marketing purposes to market services and products and to provide recommendations and other non-transactional communications by email.

(c)         Our newsletters are distributed via Mailchimp which is owned and operated by The Rocket Science Group LLC which is part of the Intuit group of companies (parent entity is IINtuit Inc).  Your Personal Information will be treated in accordance with Mailchimp’s privacy policy and terms of use so your Personal Information may be shared within the Intuit Inc group of companies (in addition to being treated in accordance with Our Privacy Policy).

(d)        We may use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would expect such use or disclosure.

(e)        We customarily only disclose Personal Information to Our service providers who assist Us in operating the Website, including but not limited to, Mailchimp and IINtuit Inc. Your Personal Information may also be exposed from time to time to maintenance and support personnel acting in the normal course of their duties.

(f)          Your Personal Information may be disclosed in the following circumstances:

(i)          Where required or authorised by law; and

(ii)         To third-parties where you have provided your consent to the use or disclosure.

(g)        By using Our Website, you consent to the receipt of direct marketing material. We will only use your Personal Information for this purpose if We have collected such information direct from you, and if it is material of a type which you would reasonably expect to receive from use. We do not use sensitive Personal Information in direct marketing activity. Our direct marketing material will include a simple means by which you can request not to receive further communications of this nature, in the form of an unsubscribe link in all emails, or you may unsubscribe from our mailing/marketing lists at any time by contacting Us in writing.

5. Security, access and correction

(a)        We store your Personal Information in a way that reasonably protects it from unauthorised access, misuse, modification or disclosure. When We no longer require your Personal Information for the purpose for which We obtained it, We will take reasonable steps to destroy and anonymise or de-identify it.

(i)          The Australian Privacy Principles (“APPs”):

(i)          permit you to obtain access to the Personal Information We hold about you in certain circumstances (APP 12); and

(ii)         allow you to correct inaccurate Personal Information subject to certain exceptions (APP 13).

(b)          Where you would like to obtain such access, please contact Us in writing on the contact details set out at the bottom of this privacy policy.  Sarah Barnett will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information.  We may require identification from you before releasing the requested information in order to protect your Personal Information.

(c)         If any information We have about you is not up to date or is inaccurate, please inform Us as soon as practicable so We can update Our records and ensure We can continue to provide quality services to you.

6. Complaint procedure

(a)          If you have a complaint concerning the manner in which We maintain the privacy of your Personal Information, please contact Us on the contact details set out at the bottom of this privacy policy.

(b)       All complaints will be considered by Our privacy officer and We may seek further information from you to clarify your concerns. If We agree that your complaint is well founded, We will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner (OAIC).

7. Overseas transfer

Your Personal Information may be transferred overseas or stored overseas for a variety of reasons, including depending on where you are located. It is not possible to identify each and every country to which your Personal Information may be sent. If your Personal Information is sent to a recipient in a country with data protection laws which are at least substantially similar to the APP, and where there are mechanisms available to you to enforce protection of your Personal Information under that overseas law, We will not be liable for a breach of the APP if your Personal Information is mishandled in that jurisdiction.

If your Personal Information is transferred to a jurisdiction which does not have data protection laws as comprehensive as Australia's, you consent to Us transferring your Personal Information to the place in which you are located (being a place where the data protection laws are not as comprehensive as Australia's) in the knowledge that if your Personal Information is mishandled in that jurisdiction, We disclaim responsibility and you will not have a remedy under Australian law.

8. GDPR

In some circumstances, the European Union General Data Protection Regulation (GDPR) provides additional protection to individuals located in Europe. Where this is the case, there may be additional rights and remedies available to you under the GDPR if your Personal Information is handled in a manner inconsistent with that law.
